TERMS OF SERVICE

Welcome to Atomic Gaming Collective, a Discord community for fans of Fallout 76, Ark: Survival Evolved, and Minecraft. By joining or participating in our Discord server (the “Community”), you agree to the following Terms and Conditions (“Terms”). These Terms are designed to keep our community safe, respectful, and in compliance with all applicable rules, including Discord’s policies. If you do not agree with these Terms, please refrain from using or participating in the Community.
1. Privacy Policy
We respect your privacy and are committed to protecting your personal data. This section explains what information we collect and how we use it:
• Data Collection: We only collect the minimum personal information necessary to operate and moderate the Community. This includes your Discord username, user ID, and any information you voluntarily provide (such as gameplay stats or social media handles). We do not require you to submit sensitive personal details to use our server.
• Use of Data: Personal data is used only for Community-related purposes, such as verifying membership, assigning roles, facilitating in-game events, and enforcing rules. For example, moderators may review message content or server activity to investigate rule violations.
• Data Sharing: We do not sell, trade, or share your personal information with third parties. Atomic Gaming Collective administrators can see your Discord profile information as permitted by Discord, but we will never disclose personal data outside the Community unless required by law or with your explicit consent.
• Third-Party Tools: We may use Discord bots or third-party services for moderation, analytics, or event management (for instance, a bot that tracks game scores or manages roles). Such tools might have access to certain server data (like messages or player activity). We vet these tools and use reputable providers, but they have their own privacy policies. We do not locally store data collected by bots beyond what Discord itself retains.
• Discord’s Privacy Policy: Please note that your use of Discord is also governed by Discord’s Privacy Policy. Discord collects and stores data (such as chat logs and account information) as described in their policy. Atomic Gaming Collective does not control Discord’s data practices, but we encourage you to review Discord’s Privacy Policy to understand how your information is handled by the platform.
By participating in the Community, you consent to our use of your data as outlined above. We take reasonable measures to secure personal data and will promptly address any privacy concerns raised by members. If you have questions about privacy or wish to request deletion of personal information specific to our Community, please contact a server administrator.
2. Monetization Disclaimer (Donations & Memberships)
Atomic Gaming Collective is a free community. Access to our Discord server and basic participation does not require any payment. However, we may offer optional ways to support the community (such as donations or membership subscriptions). This section clarifies how monetization is handled:
• Voluntary Contributions: Any donations, tips, or membership fees are entirely voluntary and are not required to enjoy the Community. We might provide links to third-party platforms (e.g., Patreon, PayPal, or Discord’s Server Subscription feature) where members can contribute to support server costs, events, or giveaways. These contributions are considered gifts to help sustain the Community.
• No Purchase of Goods/Services: Contributions do not equate to purchasing a product or service. While we may express gratitude or offer small perks to supporters (for example, a special Discord role, access to supporter-only channels, early access to community events, or cosmetic in-game rewards where allowed), these are token acknowledgments and not priced commercial goods. Any perks offered are clearly described, and supporters understand they are donating to help the community, not buying an item or guarantee.
• Transparency and Disclosure: We strive to be transparent about how donations are used (such as funding server boosts, running community game servers, or hosting tournaments). Any membership program or donation drive will include details on what supporters can expect (if anything) and the cost. We will also identify if a contribution is a one-time donation or a recurring membership.
• No Refunds (Unless Required): All contributions are final. Because donations are voluntary gifts, we typically cannot offer refunds. If you choose to support us, please do so knowing that refund requests may not be accommodated. (In extraordinary circumstances or where required by applicable law, we may consider refunds at our discretion, but this is not guaranteed.)
• Third-Party Payment Terms: When making a contribution, you may be using third-party services or Discord’s native payment system. Any financial transactions are handled through those platforms, not by Atomic Gaming Collective directly. This means any payment information (credit card, PayPal account, etc.) is processed by the third-party provider, subject to their terms and privacy policy. We do not see or store your sensitive payment details. Please review the terms of the payment platform you use (for example, Discord’s own payment terms or PayPal’s terms of service) for information on fees, security, and refund policies.
• Discord Monetization Features: If our server offers Discord’s Server Subscriptions or uses features from Discord’s monetization program, those are governed by Discord’s Monetization Terms and Monetization Policy. We will comply with Discord’s rules, including accurately describing any perks or content o ffered through a subscription. Any paid membership tier will be optional and additive – it will not remove existing free features of the community.
We include this monetization disclaimer to ensure clarity that supporting the community is optional and done in the spirit of goodwill. Whether or not you donate or subscribe, you remain subject to the same rules and will be treated equally in the Community. Monetary support will never excuse rule violations or grant undue influence over community decisions.
3. Community Guidelines & Discord Policies
We are dedicated to maintaining a friendly, inclusive, and safe environment for all members. As a Discord community, we strictly adhere to Discord’s Terms of Service and Discord’s Community Guidelines, and we require our members to do the same:
• Discord’s Terms of Service: All members must follow Discord’s Terms of Service. These are the official rules set by Discord for using their platform. By using Discord (and our server), you have already agreed to those terms. Our Community does not supersede Discord’s rules — instead, we enforce them within our server. For example, per Discord’s Terms, users must be at least 13 years old; we will remove anyone we discover to be under this age.
• Discord’s Community Guidelines: We uphold Discord’s Community Guidelines which outline what is and isn’t allowed on the platform (such as prohibitions on harassment, hate speech, violent or graphic content, illegal activities, etc.). All content and conduct within Atomic Gaming Collective must comply with these guidelines. This means no harassment or bullying, no discriminatory language, no sharing of explicit or illicit content, and no spamming or malicious behavior. We expect members to treat each other with respect and to keep the community safe for everyone.
• Community Rules: In addition to Discord’s global rules, Atomic Gaming Collective may have its own server-specific rules or codes of conduct (for example, guidelines on channel usage, spoiler tags for game content, trading etiquette in games, etc.). These will be posted in a relevant channel (such as #rules or an announcements channel) or on our website if applicable. By agreeing to these Terms, you also agree to follow all posted server rules. While these rules will be in the spirit of Discord’s policies (and often overlap), they may include additional expectations tailored to our community (e.g., “No clan recruitment posts in general chat,” or “Use voice channels for voice communication instead of spamming text,” etc.).
• Enforcement: Our moderation team (admins and moderators of the server) has the right to enforce these Terms, Discord’s policies, and our community rules. We may issue warnings, remove messages, or mute/kick/ban members who violate guidelines. Major offenses (such as hate speech, threats, hacking/cheating in games, or anything that violates Discord’s Terms of Service) will result in immediate removal and potential reporting to Discord’s Trust & Safety team. Minor issues might receive a warning or temporary timeout. We aim to enforce rules consistently and fairly, but moderation actions are ultimately at the discretion of the admins in order to protect the community.
• Reporting: Members are encouraged to report any content or behavior that violates these guidelines. You can contact a moderator directly or use any designated reporting channel or bot command if available. We will review reports and take appropriate action. We also reserve the right to involve Discord’s support or law enforcement if a situation warrants (for example, someone posting illegal content or threats).
By participating in Atomic Gaming Collective, you affirm that you will uphold these standards. We want everyone to have fun playing together, and that’s only possible when we all follow the rules and treat each other with respect. Failure to follow Discord’s Terms or Community Guidelines can not only result in removal from our server but could also lead to Discord taking action on your account, so please take these rules seriously.
4. Limitation of Liability
Atomic Gaming Collective and its administrators (server owners and moderators) provide this community and any related services “as is” and “as available,” without any warranty or guarantee of any kind. By using our Discord server or participating in community activities, you understand and agree to the following disclaimers:
• No Warranties: We make no guarantees that the community will be available uninterrupted, error-free, or secure at all times. While we strive to maintain an active and safe server, unexpected downtime, technical issues, or even moderation mistakes can occur. We disclaim all warranties, express or implied, including warranties of merchantability or fitness for a particular purpose. (In plain terms, we’re doing our best to run a great community, but we can’t promise perfection or assume liability if something goes wrong.)
• User-Generated Content: The content shared in our community (posts, messages, links, voice chats, etc.) is largely created by members, not by Atomic Gaming Collective admins. We are not responsible for the views, opinions, or actions of individual users. You may encounter other members’ opinions, advice, or trading offers that we haven’t vetted. While we enforce rules to remove harmful content, we are not liable for any content that appears before it’s moderated or that may evade our detection. Each user is accountable for what they post. If you choose to follow advice or click links shared by other members, you do so at your own risk.
• In-Game Events and Trades: Our community often teams up for activities in Fallout 76, Ark, or Minecraft (e.g., raids, missions, trading items, PvP events). Participation in these in-game events is voluntary and at your own risk. We are not liable for any in-game losses, damages, or penalties (such as your character dying in-game, loss of items, or game bans) that occur while playing with our community. We expect everyone to follow the games’ terms of service and codes of conduct. Our admins and organizers do their best to coordinate fair and fun events, but they aren’t responsible for unpredictable in-game outcomes or player behavior.
• No Liability for Damages: To the fullest extent permitted by law, Atomic Gaming Collective and its team shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or relating to your use of the Community. This includes, for example, any loss of data, loss of digital assets (like in-game items), reputational harm, account issues, or personal injuries resulting from interactions on our Discord server or in related games. We are a group of gaming enthusiasts running a fan community; we cannot assume responsibility if something unfortunate happens during your time with us.
• Personal Responsibility: You use our Discord server and participate in community events at your own discretion and risk. It is your responsibility to have adequate protections in place (for instance, using antivirus software when downloading any files or mods shared by members, or being cautious when sharing personal information with others). If you have a dispute with another member or experience any problem, you agree that the Atomic Gaming Collective admins will not be held financially or legally responsible for it. Nonetheless, we do care about our members’ well-being and will attempt to help mediate or resolve issues within the scope of our rules.
Summary: We’re here to facilitate a fun gaming community, but we can’t be on the hook for every possible problem. In joining Atomic Gaming Collective, you agree that our liability is limited and that you won’t seek to hold us responsible f or various issues outlined above. This limitation of liability applies to the maximum extent allowed by the laws in your jurisdiction. Some regions don’t allow certain liability exclusions; if so, our liability is limited to the minimum permitted by law.
5. Additional Provisions
Lastly, here are some additional legal points and clarifications to ensure everything is covered:
• Age Requirement: Our community is intended for individuals 13 years of age or older, in accordance with Discord’s Terms of Service (which require users to be at least 13, or higher if mandated by local law). By joining Atomic Gaming Collective, you affirm that you meet this age requirement. If it comes to our attention that a member is under the minimum age, we will remove them from the server to comply with Discord’s policies. Parents or guardians should supervise minors’ online activities; however, this community is not intended for young children.
• No Affiliation (Fan Community Status): Atomic Gaming Collective is an unofficial, fan-run community. We are not affiliated with or endorsed by Discord Inc., Bethesda Softworks (developer of Fallout 76), Studio Wildcard (developer of Ark: Survival Evolved), Microsoft/Mojang (developers of Minecraft), or any other company associated with the games we play. All game titles, logos, and trademarks mentioned (Fallout, Ark, Minecraft, etc.) are property of their respective owners. Our use of these names is purely for identification of the games around which our community is centered, and no infringement is intended. We’re just passionate gamers sharing our love for these titles.
• Intellectual Property: The content created by the community’s administrators (such as our server logo, any custom artwork, or original event materials) is the property of Atomic Gaming Collective. You may not use our branding or assets outside the community without permission. Content that members post (screenshots, fan art, mods, etc.) remains their own property; by sharing it in the server, you grant us a non-exclusive right to display that content within the Discord server and associated community platforms (for example, if we compile a screenshot gallery or recap an e vent on a website or social media, we might feature things shared by members). We will not, however, sell or license user-generated content without permission from the creator. If you believe someone in the community is infringing on your intellectual property (e.g., posting your artwork without credit or permission), please notify an admin and we will address the issue promptly.
• Changes to These Terms: We may occasionally update or modify these Terms and Conditions. Reasons for updates might include changes in Discord’s policies, adding a new feature to the community, or improving clarity and coverage of these rules. When significant changes occur, we will provide notice to members – for example, by posting an announcement in the Discord server or updating the effective date at the top of this document. Continued participation in the community after changes are made constitutes acceptance of the revised Terms. We encourage you to review this document periodically. If you do not agree to a change, you should discontinue your membership in the server.
• Severability: If any provision of these Terms is found to be illegal or unenforceable, the rest of the Terms will remain in effect. In other words, just because one part is invalidated by a court (or by Discord’s policies) does not mean the entire agreement is void. We will interpret the remaining provisions in a way that best fulfills the original intent.
• Governing Law: Atomic Gaming Collective is a global community, but the admins operate from USA. These Terms will be governed by the laws of that jurisdiction, without regard to its conflict of law principles. However, we primarily rely on Discord’s platform and rules for dispute resolution. We prefer to solve issues informally within the community where possible. (This clause is mainly here for legal completeness; we do not anticipate legal disputes, and by using this community you agree to approach the community admins or Discord’s own reporting system rather than courts for any issues arising.)
• Contact Information: If you have any questions, concerns, or feedback about these Terms and Conditions (or any other aspect of the community), please reach out to us. The easiest way is to contact a server administrator or moderator via Discord (you can find a list of staff in the server member list, typically with a special role indicator). If you prefer email or another method, we can provide a contact email upon request. We are open to discussing any concerns you have about privacy, safety, or rules in our community.
